TERMS OF USE

1. Introduction: These Terms of Use for all Users govern your use of Beefies and your agreement with us.
2. Interpretation: In the Terms of Use
1. we refer to our website as "Beefies"
2. references to "we", "our", "us" are references to KC Content Creators Collective LLC, the operator of Beefies;
3. "Creator" means a User who has setup their Beefies account to request Invitations to Collaborators;
4. "Collaborator" means a User who allows other Creators to request Invitations to Collaborate;
5. "Invitation" means a detailed Collaboration by which a User can setup Scene Agreements, Timelines and Spaces;
6. "Scene Agreement" means a collective agreement that both Creators agree to for the Scene;
7. "Timeline" means the given User will perform the duties of the agreed upon Timeline item;
8. "Spaces" means a physical or digital location in which the Collaboration occurs;
9. "Subscription" means a User's subscription to Beefies for the given features;
10. "Terms of Service" (also called "your agreement with us") means the legally binding agreement between you and us;
11. "User" means any user of Beefies (also referred to as "you" or "your");
3. Who we are and how to contact us: Beefies is operated by KC Content Creators Collective LLC. We are a limited company registered in Kansas;

4. Registering with Beefies To use Beefies you must first register and create a User account Beefies. You must provide a valid email address and a password. Your password must be unique (meaning that it is different to those you use for other websites) and must meet or exceed the complexity requirements of Beefies. To register as a User:
• you must be at least 18 years old, you will be required to confirm this;
• you must be a resident of the United States of America
If you do not meet the above requirements, you must not access Beefies.
5. Your commitments to us: When you register with and use Beefies, you make the following commitments to us:
• If you previously had an account with Beefies, you confirm that your old account was not terminated or suspended by us because you violated any of our terms or polices.
• You consent to receiving communications from us electronically, including emails and messages posted to your Beefies account.
• You will keep your account/login details confidential and secure, including your user details, passwords and any other piece of information that forms part of our security procedures, and you will not disclose these to anyone else. You will contact mailto:support@beefies.com promptly if you believe someone has used or is using your account with your permission or if your account has been subject to any breach of security.
6. How do I delete my account? If you want to delete your Beefies account then you may do so in Settings section of your User Profile;
7. Who is responsible for any loss or damage suffered by you?
• We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes (i) liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors, and (ii) fraud or fraudulent misrepresentation.
• If you are a User, you agree that:
• We and our subsidiary companies, employees, owners, representatives, and agents:
• are not responsible to you for any loss or damage suffered by you that is not a foreseeable result of our breaching the Terms of Service or our failing to use reasonable care and skill.
• won't be liable to you for any:
• loss of profits;
• loss of sales, business, or revenue;
• business interruption;
• loss of anticipated sales;
• loss of business opportunity, goodwill or reputation;
• indirect or consequential loss or damage;
8. General: You agree that:
• If any aspect of your agreement with us is unenforceable, the rest will remain in effect.
• If we fail to enforce any aspect of your agreement with us, will not be a waiver;
• We reserver all rights not expressely granted to you.
9. Services Included: Not limited to and subject to change
• Included with all members
• Access to the US Network of Content Creators
• Request Invitations for Potential Collaborations
• Real-time Communication with Invitees
• Direct Profile QA generation for branding at events and conferences
• Find other Content Creators in your area
• Profile that includes filterable metrics for your art style, genre and medium for Content Creation
• Paid for services include
• Search by City or Zip
• Unlimited Access to create invitations
• Find and join Friends creating content at events and conferences
• Filters for Content Creators that share your medium, art style and genre
• Promote Collaborator travel by creating campaigns using Finder+© for dates/times, cities and filters of places you're visiting
• In-app, Email and SMS based notifications to ensure you keep creating content
10. Refunds
• Purchases are final and non-refundable. You may unsubscribe for any reason, at any time, ensuring you will not be billed again for that subscription
11. Cancellations
• Subscriptions are non-refundable
• Turning off auto-renew stops you from being billed in the next renewal period if you do not wish to use the full features of Beefies
• Visit your User Profile to see your current membership
12. Plans
• Free User: - This user allows general access to Beefies and includes an limited number of invitations per day and account. A user that does not auto-renew or fails to renew due to Payment decline or failure will back back to this membership.
• Active Member: - This user has an active membership and subscription to Beefies and is eligible to access all the features provided in the Services Included section of this agreement
13. Discounted and Promotional Subscriptions - All discounts and promotions are at the discretion of Beefies and are subject to change without notice. Please see the Memberships section of your User Profile to see any active or discounted memberships
